Why mediation works, when it works
Both sides confront the real strength of their position
Mediation puts both sides in front of a neutral third party, forced to reckon with the actual strength of their case rather than the version each side has been telling itself. That only works to a client's advantage if the case has been prepared as though it were actually going to trial. A file built only for negotiation is usually apparent to the other side, and it shows up in the number they are willing to offer.

Documentation gathered and organized
The same file that would go to trial, not a lighter version built just for a settlement conversation.
Damages calculated and supportable
A number that holds up to scrutiny, not an opening position meant to be negotiated down from immediately.
A clear sense of trial value
What a verdict would realistically look like is the actual anchor for any number discussed in the room.
Mediation is often faster, less expensive, and less public than trial, but it is not automatically the right choice in every case. I discuss that tradeoff honestly before recommending it, and give clients a candid read on what a reasonable resolution looks like before the day of mediation, not for the first time during it.
